Establishment of the Court of Jurisdictional Disputes

The President and Members of the Court of Jurisdictional Disputes are appointed from among the Presidents and Members holding office at the other 3 High Courts and assume these offices as a “secondary duty”.

President of the Court of Jurisdictional Disputes is elected among the justices of the Constitutional Court and serves both as the justice of the Constitutional Court and the President of the Court of Jurisdictional Disputes concurrently. Deputy President is elected through the same procedure and serves accordingly.

Members of the Court of Jurisdictional Disputes 
The Court of Jurisdictional Disputes consists of one President, six regular and six substitute members.

Three regular and three substitute members are elected by and from among the heads and members of the General Assembly of Civil Chambers of Court of Cassation and Plenary Assembly of the Council of State.

The quorum for meeting is maintained by the attendance of substitute members in case of an excuse on the part of the regular members.

Prosecutor: The chief public prosecutor of the Court of Cassation, the chief prosecutor of Council of State (or the prosecutors to be assigned by them) serve also as the prosecutors of the Court of Jurisdictional Disputes and submit their oral or written opinions as per Law No. 2247.

Rapporteur: The Court of Jurisdictional Disputes shall be assigned sufficient number of interim rapporteurs to assist the works inasmuch as that may be deemed necessary by the President.

Interim rapporteurs shall be assigned temporarily by the competent authorities of their institutions, upon the request of the President of the Court of Jurisdictional Disputes and the relevant rapporteurs’ consent, from among those who have served at least for four years as a judge or prosecutor and who are considered to contribute to the Court of Jurisdictional Disputes with their outstanding success. Provisions relating to the professions of these rapporteurs shall apply to their personnel affairs, and the terms during which they will serve as a rapporteur shall be taken as a basis for the total length of their office terms. However, the written opinion to be issued by the President of the Court of Jurisdictional Disputes shall be instrumental in their promotion.
